Status Update: Held in committee February 2023, new sponsors added and reassigned to the House Energy & Environment Committee March 2024.
"Compact fluorescent lamp" means a compact low-pressure, mercury-containing, electric-discharge light source in which a fluorescent coating transforms some of the ultraviolet energy generated by the mercury discharge into visible light, and includes all of the following characteristics:

One base (end cap) of any type, including, but not limited to, screw, bayonet, 2 pins, and 4 pins.

Integrally ballasted or non-integrally ballasted.
-
Light emission between a correlated color temperature of 1700K and 24000K and a Duv of +0.024 and -0.024 in the International Commission on Illumination (CIE) Uniform Color Space (CAM02-UCS).
-
All tube diameters and all tube lengths.
-
All lamp sizes and shapes for directional and nondirectional installations, including, but not limited to, PL, spiral, twin tube, triple twin, 2D, U-bend, and circular.
“Linear fluorescent lamp" means a low-pressure, mercury-containing, electric discharge light source in which a fluorescent coating transforms some of the ultraviolet energy generated by the mercury discharge into visible light, and includes all of the following characteristics:

Two bases (end caps) of any type, including, but not limited to, single-pin, two-pin, and recessed double contact.

Light emission between a correlated color temperature of 1700K and 24000K and a Duv of +0.024 and -0.024 in the CIE CAM02-UCS.

All tube diameters, including, but not limited to T5, T8, T10, and T12.,

All tube lengths from 0.5 to 8.0 feet, inclusive.

All lamp shapes, including, but not limited to, linear, U-bend, and circular.

of any lamp size or shape for directional and nondirectional installations, including but not limited to PL, spiral, twin tube, triple twin, 2D, U-bend, and circular;

in which a fluorescent coating transforms some of the ultraviolet energy generated by the mercury discharge into visible light;
-
that has one base or end cap of any type, including but not limited to screw, bayonet, two pins, and four pins;
-
that is integrally ballasted or non-integrally ballasted; and
-
that has light emission between a correlated color temperature of 1700K and 24000K and a Duv of +0.024 and -0.024 in the International Commission on Illumination (CIE) Uniform Color Space (CAM02-UCS);
"Linear fluorescent lamp" means a low-pressure, mercury-containing, electric-discharge light source:

that has two bases or end caps of any type, including but not limited to single-pin, two-pin, and recessed double contact; and
-
that has light emission between a correlated color temperature of 1700K and 24000K and a Duv of +0.024 and -0.024 in the CIE CAM02-UCS;
"Mercury vapor lamp" means a high-intensity discharge lamp, including clear, phosphor-coated, and self-ballasted screw base lamps, in which the major portion of the light is produced by radiation from mercury typically operating at a partial vapor pressure in excess of 100,000 pascals;
"Mercury vapor lamp ballast" means a device that is designed and marketed to start and operate mercury vapor lamps intended for general illumination by providing the necessary voltage and current;
"Specialty application mercury vapor lamp ballast" means a mercury vapor lamp ballast:
-
designed and marketed for operating mercury vapor lamps used in quality inspection, industrial processing, or scientific applications, including fluorescent microscopy and ultraviolet curing;
-
the label of which states "For specialty applications only, not for general illumination" and indicates the specific applications for which the ballast is designed.
New York
Currently there are limits to the amount of mercury in lamps under the state conservation law. The pending legislation is to amend the conservation law to add all “Mercury containing lamps" to the mercury containing articles that are banned in the state. The pending legislation is still in committee.
Current law also allows for exemptions for special purpose lights until 2026. It is likely that that these exemptions could be removed and all lamps, if they are not outright banned, will be required to have the same limits as noted below.
“Mercury-added lamp" means an electric lamp to which mercury or mercury compounds are intentionally added during the manufacturing process, including, but not limited to, compact fluorescent lamps, fluorescent lamps and tubular fluorescent lamps with normal or long lifetime.
Current NY State Mercury limits:
On and after January first, two thousand twenty-one, no producer of mercury-added lamps shall sell, offer for sale, or distribute such lamps that fail to meet mercury content standards adopted by the department pursuant to rules and regulations. Such standards shall include what, if any, allowance should be granted for slight variations in the amount of mercury resulting from production variances. For the following general purpose lights, mercury content shall be no higher than:

2.5 milligrams for screw-based compact fluorescent lamps less than thirty watts;
-
3.5 milligrams for straight fluorescent T8 lamps with a normal lifetime (excluding 8-foot models) and 3.0 milligrams for straight fluorescent T5 lamps with a normal lifetime;
-
5.0 milligrams for straight fluorescent T8 and T5 lamps with a long lifetime;
-
15.0 milligrams for non-linear fluorescent T8, T5, and T12 lamps and 8-foot linear fluorescent lamps (excluding very high output models);
“Producer of mercury-added lamps" means any person who:
-
manufactures and sells mercury-added lamps under its own brand;
-
resells under its own brand equipment produced by other suppliers, a reseller not being regarded as the producer of mercury-added lamps if the brand of the producer of mercury-added lamps appears on the equipment, as provided for in paragraph (a) of this subdivision; or
-
serves as the importer or domestic distributor of a mercury-added lamp if the brand name owner is located outside of the United States.
“Mercury-added consumer product" means any device or material into which elemental mercury or mercury compounds are intentionally added during such device's or material's formulation or manufacture, and in which the continued presence of mercury is required to provide a specific characteristic, appearance or quality, or to perform a specific function. Such term shall include, but not be limited to mercury-containing lamps.
